AGREEMENT TO TERMS

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.

PLANT CARE & DISCLAIMER

We provide general care instructions for our plants, but it’s important to note that each plant is unique and may have specific care requirements. It is your responsibility to understand and provide appropriate care for the plants you order. We cannot be held liable for any plant damage or failure resulting from improper care, neglect, or failure to follow provided care instructions.

PLANT CONDITION DISCREPANCY

At Dugi, we take great care to ensure that the plants you receive meet the highest standards of quality and health. However, we understand that discrepancies in plant condition may occur during the ordering and shipping process. To address this, we have established the following terms and conditions:

  1. Accurate Plant Descriptions
    We strive to provide accurate descriptions and images of our plants on our website. However, please note that plant appearances can vary due to factors such as seasonal changes, growth stages, stock availability, and natural variations within plant species. The images displayed are for illustrative purposes and may not perfectly represent the exact appearance of the plants you receive.
  2. Pre-Packaging Plant Photos
    To ensure transparency and address any potential discrepancies, we take photos of each plant before it is carefully packaged for shipping. These photos serve as documentation of the plant’s condition at the time of packaging. In the rare event of a condition dispute, we may request the customer to provide photos of the plant upon arrival for comparison.
  3. Plant Inspection and Quality Control
    Our dedicated team thoroughly inspects each plant, including the roots, stems, leaves, and overall health, before packaging it for shipment. We carefully select plants that meet our stringent quality standards, aiming to provide you with healthy and vibrant plants.
  4. Packaging for Protection
    We take utmost care in packaging our plants to safeguard them during transit. We use appropriate materials and techniques to protect the leaves, stems, and roots, minimizing the risk of damage or stress during shipping.
  5. Customer Notification
    In the rare event that a significant discrepancy in plant condition is identified before shipping, we will promptly notify the customer. We will provide options such as offering a replacement plant, suggesting a similar alternative, or issuing a refund.
  6. Customer Responsibility
    Upon receiving your plants, it is essential to take a video as you unpack and inspect them promptly. If you notice any issues or discrepancies with the plant’s condition, please notify us within a specified timeframe, accompanied by clear photographic evidence and the unboxing video. This allows us to understand the concern and work towards an appropriate resolution.

REFUNDS & REPLACEMENTS POLICY

Dugi has a 2-days replacement policy. Please contact us at support@dugihouse.com to initiate a replacement product. It is at our discretion to determine whether a replacement, refund (partial or full), or store credit will be issued. Please note that replacement, store credit, or refund will be for the damaged portion of your order. Dugi may request further information and pictures. Pictures and the unboxing video are required as proof of damage. Dugi has the sole right to decide whether a replacement, refund (partial or full), or store credit will be issued without photos. We do not replace plants if they are left outside in extreme temperatures upon delivery.

At this time, Dugi only accepts refunds and replacements for all unopened root wrapping, completely damaged plants which cannot be treated, so please do not repotting the plants within 2 days of purchase. It is at our discretion to approve the condition of the refunds. Refunds are processed within 7 days after we approved the conditions.

Dugi has a no cancellation policy, all sales are final.

DISPUTE & CLAIM

We value your satisfaction as our customer and strive to provide you with the best possible experience when ordering plants from our shop. In the event that your plants arrive damaged or do not meet your expectations, we kindly ask you to review and acknowledge the following terms and conditions before considering reporting our shop to PayPal or any other payment provider:

  1. Communication and Notification
    We encourage open and timely communication regarding any concerns or issues with your order. If your plants arrive damaged or fail to meet your expectations, please notify us within a specified timeframe, accompanied by clear photographic evidence. This enables us to understand the situation and work towards a resolution.
  2. Resolution Attempts
    We are committed to resolving any issues that may arise regarding damaged plants or items that do not meet expectations. We will make reasonable attempts to offer a suitable resolution, such as providing replacement plants, offering a partial refund, or suggesting alternative options.
  3. Return or Evidence Requirements
    Depending on the nature of the issue, we may request the return of the damaged plants or additional evidence to support your claim. This may include photos, videos, or any other relevant documentation. We appreciate your cooperation in providing the necessary information to facilitate the resolution process.
  4. Refund or Store Credit
    If the situation warrants a refund or compensation, we will determine the appropriate course of action. This may involve issuing a refund to your original payment method or providing store credit that can be used towards future purchases.
  5. Non-Engagement with Payment Providers
    We kindly request that you refrain from reporting our shop to PayPal or any other payment provider without first engaging in communication with us to address the issue. We are committed to resolving customer concerns and believe that direct communication provides the best opportunity for a mutually satisfactory resolution.
  6. Limitations and Exclusions
    Our ability to address and resolve issues is subject to certain limitations and exclusions. These may include instances where the damage or issue is a result of improper care or handling after delivery, failure to follow provided care instructions, or exceeding the specified notification timeframe.
  7. Good Faith Effort
    We assure you that we will make a good faith effort to address and resolve any concerns regarding damaged plants. We value our customers and strive to provide exceptional service and quality products.

By placing an order with us, you acknowledge and agree to these terms and conditions regarding reporting damaged plants or items not meeting expectations. We appreciate your understanding and cooperation in working with us to resolve any concerns that may arise.

We understand that making a decision to order plants online/importing plants can sometimes be uncertain. If you have any doubts or reservations about placing an order, we kindly request that you refrain from proceeding with the purchase. It is better to avoid any potential issues or disappointments that may arise if we are not on the same page. We value transparency and want to ensure a positive experience for both parties involved.

PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy page. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms and Conditions. Please be advised the Site is hosted in the Indonesia.

If you access the Site from the European Union, Americas, Asia, or any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the Indonesia, then through your continued use of the Site, you are transferring your data to the Indonesia, and you expressly consent to have your data transferred to and processed in the Indonesia.

  18. except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
  19. disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.

A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

LIMITED WARRANTY

Any Plants purchased from Dugi will be guaranteed for a period of fourteen (14) days from the date of sale (“Warranty Period”). If the Product fails to conform to this Limited Warranty during the Warranty Period, Dugi will, at its sole discretion, either (a) replace any defective Product or component; or (b) accept refund of the money actually paid by the original purchaser for the Product. If the Product or a plants incorporated within it is no longer available, Dugi may, at Dugi’s sole discretion, replace the Product with a similar product of similar price. This is your sole and exclusive remedy for breach of this Limited Warranty. Any Product that has either been replaced under this Limited Warranty will be covered by the terms of this Limited Warranty for the longer of (a) fourteen (14) days from the date of delivery of the replacement Product, or (b) the remaining Warranty Period. Before making a claim under this Limited Warranty, the owner of the Product must (a) notify Dugi of the intention to make a claim by contacting us at support@dugihouse.com during the Warranty Period and providing a description and photographic proof including the unboxing video of the alleged failure, and (b) comply with Dugi’s replacement shipping instructions. Dugi will have no warranty obligations with respect to a returned Product if it determines, in its reasonable discretion after examination of the returned Product, that the Product is an Ineligible Product (defined below). This Limited Warranty does not cover the following (collectively “Ineligible Products”): Products that have been subject to: (a) modifications, alterations, tampering, or improper maintenance or repairs; (b) handling, storage, installation, testing, or use not in accordance with the Terms of Use or other instructions provided by Dugi; (c) abuse or misuse of the Product; (d) events outside of Dugi’s control, including breakdowns, fluctuations, or interruptions in electric power or the telecommunications network; or (e) Acts of God, including but not limited to lightning, flood, tornado, earthquake, or hurricane. This Limited Warranty does not apply to anything other than the Products, including the Services, even if packaged or sold with the Products. Dugi does not warrant that the operation of the product will be uninterrupted or error-free. This Limited Warranty gives you specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this Limited Warranty may not apply in certain states. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights you should refer to the laws applicable in your jurisdiction and you may wish to contact a relevant consumer advisory service.
